General conditions of "DietMed" Ltd.

Our only goal is to build harmonious and loyal relationships, openness and fairness. We therefore ask that you familiarize yourself thoroughly with our Terms and Conditions, which will be our faithful companion. In case of any questions or doubts of any nature, we assure you that you will receive professional and adequate assistance in all respects. We note here that these Terms and Conditions will be strictly enforced in any legal relationship that DietMed Ltd enters into with you.
- Background.
In compliance with the legal requirements for the provision of prior information, pursuant to Article 4 et seq. of the CPA, DieteticMed Ltd. makes these General Terms and Conditions, Privacy Policy and Cookie Policy available to users in an accessible manner by posting them on the website of DieteticMed Ltd. or, at the request of the customer, otherwise on a durable medium in the form of an understandable text in Bulgarian. In compliance with the requirements of the law concerning contracts concluded remotely by electronic means, DieteticMed Ltd. shall promptly make available to its customers all the necessary information in advance, within a period sufficient for making an informed decision on the use of the respective service/good, respectively for concluding a contract.
- Definitions.
"Consumer" means any natural person who acquires goods or uses services not intended for the pursuit of a commercial or professional activity and any natural person who, as a party to a contract under this Act, acts outside the scope of his commercial or professional activity. - 'Supplier' means any natural or legal person in the supply chain of the good who, in the course of business, transfers ownership of, or establishes or transfers other rights in rem in, a good to another supplier or trader, or who enters into a contract with a consumer in the public or private sector.
- 'Selling price' means the final price per unit or per quantity of a good or service, including taxvalue added tax and any additional taxes and charges.
- "Goods" is a term within the meaning of § 6, item 18 of the Additional Provisions of the Act on the Provision of Digital Content and Digital Services and on the Sale of Goods.
- "Service" means any material or intellectual activity which is carried out in an independent manner, is intended for another person and does not have as its main object the transfer of possession of a thing.
- 'Commercial practice' means any act, omission, conduct, commercial initiative or commercial communication, including advertising and marketing, by a trader to a consumer which is directly related to the promotion, sale or supply of a good or the provision of a service to consumers.
- A "contract of sale" is any contract under which the trader transfers or undertakes to transfer the ownership of goods to the consumer, including contracts having as their object both goods and services.
- A "service contract" is any contract under which the trader provides or undertakes to provide a service to the consumer, including a digital service.
- A "means of distance communication" is any means which, without the simultaneous physical presence of the trader and the consumer, can be used to conclude a contract between the parties, such as addressed and unaddressed printed material, standard letter, press advertisement with order coupon, catalogue, telephone (with or without the presence of a person), radio, television, videophone, videotext, sms message, computer, e-mail, internet, fax, mail order.
- 'Payment instrument' means a personalised device and/or a set of procedures agreed between the payment service user and the payment service provider and used by the payment service user to execute a payment order.
- "Personal data" means personal data within the meaning of Article 4(1) of Regulation (EU) 2016/679.
- Objectives and Scope of the Terms and Conditions.
These General Terms and Conditions regulate the relations between DietMed Ltd. and the users of goods and services available at www.dietitianmed.com
"DietMed" Ltd. is a platform through which customers have the opportunity to conclude contracts for the remote purchase and sale of the goods and/or services offered. The General Terms and Conditions are binding on all persons who visit and/or use the Site, purchase Goods/Services online and/or register at www.dietitianmed.com. In the event of a conflict between the provisions of a separate contract and the provisions of the General Terms and Conditions, the contract shall prevail.
The Merchant shall have the right to unilaterally change the Terms and Conditions, including but not limited to, to reflect the manner in which the Site operates, to change the Goods/Services, their parameters and characteristics, any delivery terms and any other information published on the Site. The Terms and Conditions may be updated and changed at any time. Customers who do not agree with the changes to the Terms and Conditions have the right to delete their Account and discontinue using www.dietitianmed.com.
Any use of the Site www.dietitianmed.com means that you have read/ have read carefully these Terms of Use and have agreed to use them unconditionally.The Terms of Use may be changed unilaterally by DietMed Ltd, and all users will be deemed to have been notified by posting the updates on the site. Changes are binding on all customers and/or users. The latest version of the terms and conditions can be viewed at any time at: www.dietitianmed.com. It is prohibited to use the Website to send or transmit any material that is unlawful, threatening, false, misleading, abusive, harassing, defamatory, libelous, vulgar, obscene, scandalous, inflammatory, pornographic or religiously incorrect content, or any material that establishes or encourages conduct that would be considered a criminal offense, give rise to civil or criminal liability, or otherwise violate the law.
Price - All goods and services offered by DieteticMed Ltd. are at prices in BGN previously announced on the website, including VAT and taxes, but excluding the cost of delivery and additional components that could increase the cost of the goods / service or its delivery. In cases where it is not possible/applicable to announce the price in advance, it shall be communicated to the customer, giving him/her a reasonable time to make an informed decision. "DieteticMed Ltd shall have the right to change prices at its sole discretion, at any time without prior notice to Users. The User is obliged to pay the price that was indicated on the website at the time of making (creating) the order, regardless of whether it is lower or higher than the current price. In the event of technical errors in the display of prices and orders placed as a result, DieteticMed Ltd reserves the right to refuse the same, in which case no compensation shall be due to the User. All products, including those on promotion or discount, are sold and delivered while stocks last, even if this is not explicitly stated on the website.
Terms of payment - In case of payment in cash for the ordered goods and services, the User is obliged to pay at the time of delivery to the person making the delivery the full value of the delivered order.
When payment is made by bank transfer, it is only and exclusively to the bank accounts of DietMed Ltd. and the order number must be entered in the reason for payment. All fees and commissions are the responsibility of the ordering party. When paying by bank transfer in Euro, the User shall pay an amount equal to the value of the order placed in BGN, calculated on the basis of the official currency fixing of the Bulgarian National Bank for the specific day. When paying electronically by debit or credit card, the User pays an amount equal to the value of the order placed and only after the transaction is confirmed, the ordered goods and services are delivered. An order number must be entered in the reason for payment. All fees and commissions are the responsibility of the ordering party. In cases of on-line payments or payments by bank transfer, DietMed Ltd shall not be liable for any costs in connection with fees, commissions or other additional payments made by the User in connection with the transaction, as well as in cases of currency conversion, the terms of which shall be applied by the bank. Costs associated with payments of this nature shall be borne solely by the User.
Delivery – Deliveries of Goods and Services shall be made by a courier designated by DietMed Ltd., operating in the territory of the Republic of Bulgaria to an address specified by the Customer or at the office of the courier company, depending on the choice of the Customer. For delivery to an address, the ordering party shall have provided an accurate address and contact telephone number, which he agrees under these General Terms and Conditions to be provided to a third party courier. In the case of door delivery, the Customer must specify the floor to which the Products are to be delivered in the address field on the Supplier's electronic order form. Transport costs associated with the delivery of the Goods/Services to the Customer's address specified in the Order are not included in the Price of the Goods as quoted on the Site. Unless otherwise agreed, transport costs shall be payable additionally by the Customer at the time of delivery of the Goods to the courier/carrier making the delivery. The cost of delivery shall be calculated at the time of placing the Order in accordance with the tariff of the courier/carrier making the delivery and shall be confirmed by the Customer together with the completion of the Order. By confirming the Order, the Customer undertakes to pay the transport costs. The delivery period for the ordered goods/services is 7 working days from the delivery of the goods to the courier, with the order being processed by DietMed Ltd. on the next working day at the latest, with the latter reserving the right to extend the period by 14 working days in cases of delay due to reasons beyond the control of the company, to which the Customer agrees upon completion of the Order, after clicking on the "Confirm Order" button. In any event, the Supplier shall not be liable for any delay in the event that the delay is due to the fault of the courier/carrier making the delivery and/or due to circumstances beyond the Supplier's control. Where an order is not delivered on time, the Customer shall allow DieteticMed Ltd one week to deliver the order and in the event that this time limit is not met, the Customer shall be entitled to cancel the order and a full refund of the amount received.
Cancellation and return - The ordered goods/service shall be subject to return/refusal of the service in case of intact commercial appearance by the Buyer having the status of a consumer within the meaning of the Consumer Protection Act or non-exercised rights under the provided service, without giving any reason and without owing any compensation or penalty, within 14 days from the date of receipt of the goods/service by the Buyer, as the costs of return/refusal of the goods/service shall be paid by the Buyer. Refund of the amount paid for the goods will be made within 30 days from the date of receipt of the goods by DietMed Ltd or from the date of termination of the service. In order to express the customer's wish to return/refuse, the customer should fill in a standard "Refusal Form", which can be found on the website of DietMed Ltd. The completed form should be sent to hi@dietitianmed.com In the event of finding defective goods or goods with deficiencies that make it impossible to use them as usual or as agreed, within 7 days of their return, DietMed Ltd. undertakes to replace them with new ones in accordance with or to refund the amount deposited for the goods within 30 days from the date on which the consumer has exercised his right of withdrawal. The transport and other costs for the receipt and return of the goods shall be borne by DietMed Ltd. In the event of non-conformity of the goods with the main characteristics indicated on the website, DieteticMed Ltd shall refund the amount deposited for the goods by the consumer, including the transport costs charged for the acquisition of the goods, within 7 days of receipt of the goods and the undamaged commercial appearance of the goods and packaging. The exception is the integrity of the transport packaging.
- Privacy.
As a personal data controller, in accordance with Article 4(7) of Regulation (EU) 2016/679 , DieteticMed Ltd, for the purpose of transparency in the processing of personal data, has an obligation to inform you of what constitutes the processing of personal data, when it is carried out and what the consequences of consent to the processing of your personal data are.
In order for processing to be lawful, the personal data should be processed on the basis of your consent or on another legitimate ground established by law in Regulation (EU) 2016/679 or in another EU or Member State legal act, as specified in the Regulation, including the need to comply with a legal obligation imposed on the controller or the need to perform a contract to which the data subject is a party or in order to take steps at the request of the data subject before entering into a contract.
We inform you that any processing of personal data must be lawful and in good faith. It should be transparent to individuals how personal data relating to them is collected, used, consulted or otherwise processed and the extent to which the processing is or will be carried out.
The principle of transparency requires that all information and communication relating to the processing of these personal data is easily accessible and understandable and uses clear and unambiguous wording. This principle applies in particular to the information that data subjects receive about the identity of the controller and the purposes of the processing, and to the additional information ensuring fair and transparent processing in relation to the individuals concerned and their right to obtain confirmation and notification of the content of personal data relating to them that are processed. Individuals should be informed of the risks, rules, safeguards and rights relating to the processing of personal data and of the means by which they may exercise their rights in relation to the processing. In particular, the specific purposes for which personal data are processed should be clear and legitimate and identified at the time of collection of the personal data. Personal data should be adequate, relevant and limited to what is necessary for the purposes for which they are processed. This requires, in particular, ensuring that the period for which personal data are kept is kept to a strict minimum. Personal data should only be processed if the purpose of the processing cannot be sufficiently achieved by other means. In order to ensure that the storage period of personal data is no longer than necessary, the controller should establish time limits for their erasure or periodic review. All reasonable steps should be taken to ensure that inaccurate personal data are rectified or erased. Personal data should be processed in a manner which ensures an adequate level of security and confidentiality of personal data, including to prevent unauthorised access to, or use of, personal data and processing equipment.
- Additions.
By accessing and using the DietMed Ltd website, you accept without limitation and uncondition these Terms of Use. This website contains material that is owned by or licensed to DietiCareMed Ltd. This material includes, but is not limited to, the design, layout, appearance and graphics of the website and the information contained therein. Reproduction of the same is prohibited except with prior permission of DietMed Ltd. In case of disagreements between DieteticMed Ltd. and its client, the provisions of the Bulgarian legislation will apply, and the parties agree in advance to use the means of "peaceful" resolution by agreement. In the event of inability to conclude such, each party is free to apply to the competent court.
